On Athlete App Privacy Notice

We are On AG ("On", "we", "us", "our"), with our registered office at Förrlibuckstrasse 190, 8005 Zurich. This privacy notice applies whenever we process any personal information about you as a user of the On Athlete Application (the "App").
On is a data controller of your personal data, which means we decide how to process your personal data and have certain responsibilities in relation to your personal data. Personal data means any information that can be directly or indirectly related to you.
This privacy notice sets out how On processes your personal data. This includes what personal data On processes, why and for what purposes. Please note that some privacy rights and obligations may differ in certain locations based on applicable data protection legislation.

Personal data we process	Why do On process it and what is On’s lawful basis?
Your name, email address and login data	On do this as is necessary under our legitimate interest, to provide, run and administer the App.
Your name, email address, login data, details of your query and details in relation to any events or services that you sign up to via the App	On do this as is necessary under our legitimate interests, to communicate with you about your use of the App and/or to provide you with the information and services that you request from us, including when you sign up to webinars or other events via the App.
Your location (determined using your device’s OS location services)	Some of our location-enabled App services require your personal data for the feature to work. If you wish to use the particular feature, you will be asked to consent to your data being used for this purpose. You can withdraw your consent at any time by disabling On’s access permissions in your device settings.
Your image or any other information that you give to us via the App.	Some of our App services may allow you to upload and send images or other content to On to use in connection with any sponsorship activity relating to our sponsorship agreement with you. If you wish to submit images or content via such features, you will be asked to consent to your data being used for this purpose. You can withdraw your consent at any time by contacting dpo@on-running.com.
Online identifiers (including IP address), device information and information about your usage of the App (including length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs) and methods used to browse away from the page)	On do this as is necessary under our legitimate interest, to provide, run and administer the App.

WHO DO WE SHARE OUR DATA WITH?

We may disclose your personal data to the following categories of third-party recipients where we consider it necessary for the purposes set out in this privacy notice:

• On affiliates.
• Third parties who provide various services to us (such as third parties who support our information technology and analytics and search engine providers that may assist us in the improvement and optimisation of our App) if this is necessary to provide you with our services, respond to your inquiries or for any other related purposes.
• Professional advisors, such as accountants, lawyers or auditors.
• Regulators or other authorities or third parties to comply with the law or assist in a criminal or regulatory investigation, or to protect us (for example, to help prevent fraud or protect or enforce our rights).
• Other parties as part of a corporate transaction, for example if it is proposed that we are to merge with or be acquired by another business in the future.

HOW WE PROTECT YOUR PERSONAL DATA

We take your online security seriously and maintain appropriate physical, organisational and technical measures so as to prevent any loss, misuse, unauthorised access, disclosure or modification of your personal data.

Please note, however, that the transmission of information via the Internet is not completely secure and we cannot guarantee the security of your personal data transmitted to us or provided through the App.

HOW LONG DO WE HOLD ON TO YOUR PERSONAL DATA FOR?

Your personal data will be retained by On for as long as it is required for the purposes for which it was collected, or as required to comply with applicable law or to defend our legal rights.

WHERE DO WE STORE YOUR PERSONAL DATA

Your personal data is stored in the European Economic Area (Ireland).
We may transfer your personal data to a recipient based in a country outside of the UK, Switzerland and/or European Economic Area ("EEA") including to another member of our global group. Where we do so, we will ensure that such transfer is in accordance with our obligations under data protection legislation. Please note that On App does not use cookies or similar technology. On does not set or use any cookies or similar technology to collect, store or track information about your usage of the App.

YOUR RIGHTS IN RELATION TO YOUR PERSONAL DATA

Under data protection legislation you have a number of rights available, namely the right to:

• access your personal data;
• correct incomplete/ inaccurate data;
• erase the personal data we hold about you;
• restrict how we handle your personal data;
• ask us to transfer your personal data to a third party;
• object to how we process your personal data; and
• withdraw your consent at any time.

You also have the right to complain to the regulator about On's information rights procedures. Where you are in the EU, you may contact your local Supervisory Authority - a full list of Supervisory Authorities in the EU can be found here. In the UK, the relevant regulator is the ICO and you can make your complaint via the ICO's website here.
